These product terms and conditions affect your rights and liabilities under the law and set out the terms under which Newmake SMWS America makes the products available to you, so please take a moment to read.


Products purchased through our website are sold to you by a New York licensed wine and spirits retailer. Title to and ownership of alcoholic beverages passes from the retailer to you in the State of New York and they are delivered to you in the State of New York. New York sales tax will be applied to these transactions, and the products will be stored on your behalf at a third party licensed warehouse facility located in the State of New York prior to pickup and fulfillment by a third party shipper. You agree to allow us to provide information regarding your designated shipping destination to the third-party for fulfillment.

Delivery will be made to the address specified by you on the completed order form. No deliveries are permitted to locations outside the United States. To ensure you receive your order safely, please give a daytime address where an adult will be present to sign for the delivery. We make no representation as to the legal rights of anyone to deliver or import any alcoholic beverages or other goods into any state. You warrant that you are solely responsible for the transport of the purchased products and for determining the legality and the tax/duty consequences of bringing the products to your chosen destination. By placing an order with us, you acknowledge that you are at least 21 years old, and that the person to whom products will be delivered is also at least 21 years old. The person receiving delivery will be required to show identification proving that he or she is at least 21 years old.

No delivery can be made to PO boxes. Please provide a physical address for all deliveries.

Couriers will attempt to deliver your package three times. If delivery cannot be made and it is returned to the warehouse, you will be charged a re-shipment fee to reship the package to you. If you request the courier hold the package at a location and fail to pick up the package within the courier time frame and it is returned to the warehouse, you will be charged a re-shipment fee to reship the package to you.

If you request a delivery to a business, the delivery will be considered completed and successful if it is delivered to a reception area and signed for by a representative at that address.

After your order has been submitted, please allow up to two business days for processing. This is an estimate though and does not include weekends or holidays.

We shall not be liable for loss occasioned by delay in delivery arising out of any cause beyond our control.


All of our products and services are subject to availability. Your website transaction is not complete until you finish the entire checkout process and click the complete order button.

You will receive an order confirmation number after completing your order as well as an email confirmation. Keep this number on record should you need to reference it for any reason.
